CFA Supports the CFPB and the New York Attorney General’s Action Against Credit Acceptance Corporation

CFA, the National Consumer Law Center, Consumer Reports and New York-based Empire Justice Center filed an amicus curae brief in support of the CFPB and the New York Attorney General’s Office in their enforcement action against subprime auto lender Credit Acceptance Corporation (CAC) in the Southern District of New York. The CFPB and the New York Attorney General allege that CAC targeted financially vulnerable car buyers by secretly inflating vehicle prices and designing an algorithm that allowed CAC to profit despite high rates of delinquency and repossessions. The amicus brief highlights the vulnerability of the consumers CAC targets, the complexities of auto financing, and points to examples of responsible credit unions that have successful auto lending portfolios without abusing consumers.
